Seller’s Terms and Conditions

This agreement outlines the terms and conditions that apply to users who wish to sell auction lots on AuctionsBulk.com. By registering as a seller and listing lots for auction, you agree to these terms.

Account Creation and Verification: Sellers must create an account to list auction lots. AuctionsBulk reserves the right to verify the information provided during account creation.

Seller’s Commission and Fees: Sellers on AuctionsBulk are subject to a commission fee of 15% of the total sale amount for each lot that successfully sells and is paid for by the buyer. This 15% commission will be deducted from the seller’s payout upon the successful sale of their lot. It’s important to note that sellers will not incur a commission fee for merely listing a lot. Commission fees are applicable exclusively when a lot is sold and paid for by the buyer.

Additionally, AuctionsBulk does not charge any listing fees for auction lots. However, please be aware that our fee structure is subject to change at AuctionsBulk’s discretion, and we will notify sellers in advance of any fee structure modifications. Sellers will only be charged a commission fee when a lot is sold and paid for by the buyer.

Listing Accuracy: Sellers are responsible for providing accurate descriptions, images, and information for their auction lots. Any misrepresentation may result in removal of listings, suspension or termination of the seller’s account, and/or legal actions.

Shipping and Handling: The buyer pays for shipping costs, but the seller is responsible for providing accurate shipping details, including weights and dimensions. Sellers are responsible for loading the buyer’s truck when arriving or applying shipping labels to the packages.

Payment: After a successful auction, the buyer’s payment is held in escrow until the buyer has received and inspected the merchandise, subject to a three-day inspection period. The seller will be paid after the buyer’s three-day inspection period, unless a dispute is filed.

Disputes and Returns: Buyers have a three-day inspection period after receiving the merchandise. In the event of a dispute, the seller must cooperate with AuctionsBulk’s dispute resolution process. Returns will only occur if the merchandise received by the buyer is not as described in the auction listing.

Legal Right to Sell and Compliance with Laws: Sellers represent and warrant that they have the legal right to sell the products they list on AuctionsBulk.com. Sellers are responsible for ensuring that the products they sell are legal and comply with all applicable laws, regulations, and standards.

Limitation of Liability: AuctionsBulk is not liable for any damages or losses incurred by the seller as a result of using the platform, except as required by law.

Changes to Terms and Conditions: AuctionsBulk reserves the right to modify these terms and conditions at any time. Sellers will be notified of any changes and must agree to the updated terms to continue using the platform.

Termination: AuctionsBulk reserves the right to suspend or terminate the accounts of sellers who violate these terms and conditions, at its sole discretion.

Governing Law and Jurisdiction: This agreement and the relationship between you and AuctionsBulk shall be governed by the laws of the State of California, without regard to its conflict of laws principles. You agree that any disputes, claims, or causes of action arising out of or related to this agreement shall be subject to the exclusive jurisdiction of the federal and state courts located in Orange County, California, and you hereby submit to the personal jurisdiction of such courts and waive any objection as to venue or inconvenient forum.

Dispute Resolution: In the event of a dispute arising out of or related to this agreement, both parties agree to first attempt to resolve the dispute amicably through good faith negotiations. If the dispute cannot be resolved through negotiations, both parties agree to participate in mediation with a neutral third-party mediator. If mediation is unsuccessful, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The arbitration shall take place in Orange County, California. The decision of the arbitrator shall be final and binding on both parties, and any award may be entered and enforced in any court of competent jurisdiction.
